Terms of Use

1) Agreement to Terms & License

These Terms of Use ("Terms") constitute a legally binding agreement between you and Aleksandr Vasilev ("Oktopunk", "we", "us") concerning your access to and use of the Flappybookmobile application ("App"). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

We grant you a personal, non-exclusive, non-transferable, revocable limited license to install and use Flappybook on Apple devices you own or control, strictly in accordance with these Terms and the Usage Rules of Apple's Media Services Terms and Conditions. Where these Terms are silent, Apple's Licensed Application End User License Agreement (Standard EULA) applies.

2) Flappybook Pro Subscriptions

Access to the App's features requires a Flappybook Pro auto-renewable subscription, offered with monthly and annual billing periods. Prices are shown in the App before purchase and may vary by region.

  • Billing: Payment is charged to your Apple ID account upon confirmation of purchase.
  • Free Trial: If a free trial is offered, you will be charged the subscription price when the trial ends unless you cancel at least 24 hours before it ends. Any unused portion of a free trial is forfeited when you purchase a subscription.
  • Automatic Renewal: Subscriptions renew automatically at the same price and billing period unless cancelled at least 24 hours before the end of the current period.
  • Account Charge: Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • Managing Subscriptions: You can manage or cancel your subscription at any time in your Apple ID Account Settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of the current billing period.
  • Restoring Purchases: You can restore an active subscription on another device signed in with the same Apple ID using the "Restore" option in the App.
  • Refunds: All purchases are processed by Apple. Refund requests must be submitted directly to Apple in accordance with the Apple Media Services Terms and Conditions.

3) Your Content & Data

You retain all rights to the content you create in the App, including notes, quotes, vocabulary cards, reading logs, and photos. This content is stored locally on your device.

Because we do not store your data on our servers, we cannot recover it if it is lost, for example after deleting the App, resetting or losing your device, or restoring from an older backup. You are responsible for keeping backups of your device. Please make sure you have the rights to any photos you add.

4) Third-Party Book Data & Services

Book titles, authors, descriptions, cover images, and word definitions shown in the App are provided by third-party services such as Google Books, Open Library, the Apple iTunes Search API, Datamuse, and the Free Dictionary API. This content belongs to its respective owners and is provided for your personal, non-commercial reference only.

We do not guarantee the accuracy, completeness, or availability of third-party data, and these services may change or become unavailable at any time. Flappybook is not affiliated with or endorsed by these providers.

5) Acceptable Use

You agree that you will not:

  • Copy, modify, reverse engineer, or redistribute the App or its artwork, characters, and design, except as permitted by law;
  • Circumvent subscription checks or otherwise access paid features without a valid subscription;
  • Use the App to scrape or bulk-download data from the third-party services it connects to;
  • Use the App for any unlawful purpose.

6) Reading Statistics

Reading time, streaks, goals, and other statistics are calculated from the sessions you record and are provided for personal motivation only. We make no guarantees regarding their precision, for example if a timer is interrupted by the operating system.

7) Disclaimer of Warranties & Limitation of Liability

Flappybook is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. To the maximum extent permitted by applicable law, in no event shall Aleksandr Vasilev or Oktopunk be liable for any indirect, incidental, special, or consequential damages, including loss of data, resulting from your use of or inability to use the App.

8) Privacy

Your use of the App is also governed by our Privacy Policy, which explains what data the App processes, including analytics.

9) Changes to Terms

We reserve the right to revise these Terms at any time. Any changes will be posted directly to this page with an updated "Last updated" date. Your continued use of Flappybook following any updates signifies your acceptance of the revised Terms.
